Federal Court Mandates Freedom of Kilmar Abrego Garcia from Immigration Detention
A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without legal authority.
"Since his release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.
The situation stems from a mistaken deportation to El Salvador in March, which US authorities later admitted was an mistake. After his return to the United States to answer alien smuggling allegations, he was detained in federal custody.
In her order, the judge pointed out that the authorities lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
Context of the Case
The court challenge center on disputed claims. While the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this allegation.
He has also pleaded not guilty to the smuggling charges, which are part of a ongoing criminal case in the state of Tennessee.
