Lawsuits Against Financial Institutions having Jeffrey Epstein Ties May Shed New Light on Financier’s Crimes

For years, victims of Jeffrey Epstein have demanded justice. For a while, it appeared like they would achieve it.

Epstein’s former associate Ghislaine Maxwell, Epstein’s ex-girlfriend, was convicted of sex trafficking four years ago for her involvement in the late financier’s exploitation of teen girls – and given to two decades behind bars.

Meanwhile, financial firms that had done business with Epstein, while not accepting fault, paid hundreds of millions in agreements to victims. Donald Trump even made disclosing the Epstein investigative files part of his election promises, and reiterated on his promise to do so in recent months.

Ultimately, Trump’s justice department did not release these records, and his government has become embroiled in allegations about personal connections between him and Epstein. Assurances from lawmakers to disclose documents have lagged, due to political jockeying and delays from federal authorities.

But two new lawsuits could provide clarity on Epstein’s activities amid the deadlock – regardless of their outcome.

Legal Actions Target Leading Financial Institutions

The legal complaints, filed by an anonymous plaintiff against Bank of America and the BNY Mellon, allege that these banking giants illicitly enabled Epstein’s sex trafficking. The suits are led by Sigrid S McCawley, of a prominent law firm, and lawyer Brad Edwards of Edwards Henderson, who have long represented survivors of Epstein’s abuse.

“The financier carried out these offenses by means of not only his own extraordinary wealth and influence, but through access to funding and financial support from both individuals and institutions, including BNY,” the legal filing states. “Shockingly, BNY had a abundance of knowledge regarding Epstein’s trafficking network but opted for financial gain over protecting the victims.”

The complaint against Bank of America mirrors these claims, declaring the institution “knowingly provided the monetary resources and the appearance of respectability for Epstein and his accomplices to fuel their international sex trafficking organization under the guise of non-criminal business activities”. The legal action also said Bank of America neglected to file mandatory financial alerts.

Attorneys Weigh In on Case Challenges

Experienced lawyers who commented on the matter said establishing liability would be challenging. But they also identified potential results which could provide solace to plaintiffs or release of long-sought information.

Neama Rahmani, a former federal prosecutor who established a legal firm, said proof has to show that an bank’s conduct led to harm.

“I don’t think the lawsuit has much of a chance of success – and obviously I am on the side of the survivors, and I want them to get answers and criminal justice and compensation,” Rahmani said. Some claims might be too tangential from a juridical perspective.

“It all comes down to evidence,” he said. A lawyer would need to prove cause and effect, which would mean “but for the defendant’s conduct, the injury wouldn’t have occurred”. In this case, that would boil down to “absent the institution’s involvement, the survivor maybe wouldn’t have been trafficked”, the lawyer explained.

An attorney would also have to go further than a “but for” measure. “Is not just ‘but for’ causation. It also has to be a substantial factor: that is the legal test. So whatever misconduct there was, if there was any wrongdoing … the bank’s actions has to have been a substantial factor in leading to the plaintiff harm.

“By engaging in a business relationship with Epstein, is that a decisive element? It’s uncertain.”

Regardless of legal responsibility, suits like this could serve as a warning that relationships with those involved in alleged crimes can have damaging implications for them.

“It’s a PR nightmare,” Rahmani noted. If the banks try to get these suits thrown out and are unsuccessful, the attorney anticipates a quick resolution. “No party desires to pursue any of the Epstein-related cases.”

Eric Faddis, a litigator and founder of the legal practice Varner Faddis and ex-government lawyer, said corporations can be responsible. In this situation, “if the institutions bear fault is going to depend, in part, on what the banks knew, whether they had any knowledge of claimed misconduct or criminal wrongdoing”, and in some way provided assistance to Epstein.

“But even then, I think it’s going to be difficult to sort of loop the financial entities into some kind of trafficking operation. The banks would likely not be aware of the details of allegations,” Faddis said. While Epstein’s Florida conviction was public, “it’s not illegal for a bank to have a client who’s an disreputable individual”.

“It is illegal for a bank to in any way be complicit in the illegal actions of a client, but these aspects are very different, and so I think that it’s going to be a tough lawsuit against the banks.”

Possible Advantages for Victims

That said, key elements of the legal proceedings could help those affected by Epstein.

“These cases may uncover additional details about the ongoing Epstein saga,” the attorney said. “Even though there have been sort of walls put up at every turn for individuals seeking this data, when there’s a legal action, there’s a evidence-gathering phase, and that discovery process often requires disclosure of materials that was not formerly available.”

Edwards said in a statement that the lawsuits could have a deterrent effect and achieve what lawmakers have failed to do.

“Legal actions are essential for full accountability for the victims of the financier – as well as for future would-be victims who will be harmed from comparable criminal networks – if our banks are not held accountable for the crucial part each performs, either in supplying the necessary infrastructure for the criminal enterprise or recognizing the monetary aspect of these offenses and stopping it.

Edwards continued: “Our prospects are significantly higher of making a real difference than lawmakers, because we understand the facts and history of the matter and are not motivated by politics but rather by a genuine desire to make a real difference and to protect the victims, who have already suffered tremendously.

“Our handling of these issues without any partisan motives and thus will not be swayed by obstructions, shielding influential figures, or the other embarrassing partisan gamesmanship you and the rest of the world have had to observe recently.”

Attorney Sigrid McCawley said in a statement: “As Congress works toward unraveling how Jeffrey Epstein was able to conduct his criminal sex-trafficking enterprise for decades without being caught, we are taking another important step forward toward justice for victims.”

Bank Responses

When requested for a statement on the legal complaint, BNY said: “The claims in the lawsuit are meritless, and we will strongly contest against it.”

Bank of America’s statement similarly remarked: “We intend to firmly protect our interests in this case.”
